In mid-June 2021, the Occupational Safety and Health Administration (OSHA) released a new COVID-19 standard for the healthcare industry. The Standard mandates that healthcare workers be protected from airborne pathogens, and contains multiple requirements, such as the adoption of a COVID-19 plan, the creation of patient screening and management protocols, the development of policies and procedures based on CDC guidelines, and much more. At the same time, New York has enacted the HERO Act, which applies to all private sector organizations. The NY HERO Act is twofold, with the first part of the Act requiring the adoption of an airborne infectious disease prevention plan, and the second part allowing for the formation of workplace safety committees. On July 6, 2021, the New York Departments of Labor and Health released joint “model prevention plans” for adoption by each covered entity by August 5, 2021.
