HCP Meets with Lawmakers; New Home Care Legislation Introduced

Throughout last week, HCP Public Policy staff and retained lobbyists Reid, McNally, & Savage (RMS), continued to meet with lawmakers and key staff on the Association’s legislative priorities. During the meetings, HCP advocated for potential amendments to previous legislation that would provide for the study and review by an independent actuary of adequate reimbursement methodologies; a delay of the new consumer directed personal assistance services (CDPAS) Wage Parity law from July 1, 2017 to December 31, 2017; Domestic Worker Bill of Rights reform; as well as support for the community paramedicine collaborative approach and rural home health care transportation reimbursement legislation.

Adequate Reimbursement Legislation Introduced

As a result of HCP’s discussion with Chair of the Senate Health Committee, Kemp Hannon (R-Garden City), and his staff, the Senator re-introduced legislation from 2015 with additional amendments. This legislation (S.5841) directs the New York State Department of Health (DOH) to provide for the study and review by an independent actuary of adequate reimbursement methodologies under managed care contracts and fee-for-service Medicaid rates to ensure such are sufficient to support compensation for persons providing home care aide services and consumer directed personal assistance services. The new amendments, as per HCP’s request, would also include the study and review of Federal Fair Labor Standards Act (FLSA) provisions as they relate to employees' overtime and other mandatory benefits, and an administrative and general cost factor indexed annually. This legislation would take effect January 15, 2018. HCP will issue a memo of support to the Senate Health Committee, which has placed this bill on their meeting agenda for next week, as well as seek an Assembly sponsor to advance this legislation.
